Michael Zwack Photography, LLC (“MZP,” “we,” “us,” or “our,” as applicable) respects the privacy of those who visit, access, use, and view www.MichaelZwack.com, any interactive services, modules, and features available on such website, and any other digital materials downloaded or otherwise obtained from us individually or collectively (whether in browser based or mobile format, as applicable, the “Site”). This privacy policy (this “Privacy Policy”) describes how we collect and use your information, including what kind of information we collect or that you may provide when you visit the Site. If you do not wish to be bound by this Privacy Policy, please do not use this Site. By accessing and using the Site, you agree to this Privacy Policy. You will you always be able to view the most current version of this Privacy Policy by clicking on the link at the bottom of the homepage of the Site. Your continued use of the Site following the posting of revisions to this Privacy Policy means that you accept and agree to the changes. We suggest that you review this privacy policy periodically as we may update it from time to time.

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. We refer to this information as “Order Information.”

We collect this information to help diagnose problems, administer our website, track usage statistics, and otherwise improve the Site and deliver a better and more personalized service.

We also collect information that you provide, such as:

  • Information you provide by filling in forms on the Site (including when you request further services);

  • Records and copies of your correspondence, if you contact us;

  • Your responses to surveys that we might ask you to complete;

  • Details of transactions you carry out through the Site and of the fulfillment of your orders (including financial information that you may provide in order to place such order).

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

When you supply us with personal information in the course of creating an account, the information you provide will be added to our customer database. You will receive periodic news from us. If you do not want to receive such communications from us, then please contact us.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. European Privacy RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

MINORS

We are committed to protecting the privacy of children. This Site is not intended for use by anyone under the age of eighteen (18), and you represent, warrant, and confirm that you are at least eighteen (18) years of age or have permission from a parent or legal guardian to access and use the Site.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of the Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

Furthermore, we adopt the following provisions of this Privacy Policy to comply with the California Consumer Privacy Act of 2018 (CCPA). Some personal information included in this category may overlap with other categories.
